These Terms of Use ("Agreement") govern your access to and use of AfricaVotes.com ("Website"). By using any Website services, you agree to be bound by this Agreement, our Privacy Policy, and all applicable laws.
Feature-specific terms for Premium Voting, Boosting, Lazy Voting, Tickets, and Live Stream form part of this Agreement when you use those services. AfricaVotes reserves the right to update these Terms without notice. Regular review of this Agreement is recommended.
This Agreement constitutes a binding contract between you and Xopa Limited ("Company", "we", "our"), a Ugandan entity operating AfricaVotes.com. The Website provides consumer-focused voting services. Commercial use without express authorization is strictly prohibited.
Section 03
Modification Rights
AfricaVotes is a live platform that supports voting, payments, organizers, tickets, live streams, analytics, and user accounts. Because these services may change over time, we reserve the right to update the Website and this Agreement when needed.
- Feature Changes:We may add, remove, redesign, pause, rename, or limit any Website feature, including voting flows, payment options, ticket tools, live stream tools, organizer dashboards, and user account features.
- Policy Updates:We may update these Terms to reflect legal requirements, payment provider rules, fraud prevention measures, product improvements, pricing changes, or new platform services.
- Availability Changes:We may adjust service availability by project, region, currency, payment method, organizer workspace, user account status, device, or risk review result.
- Technical Requirements:We may update browser, device, network, verification, security, or authentication requirements to keep the Website stable and secure.
- Immediate Effect:Unless a later effective date is stated, changes become effective when posted on the Website or when the relevant feature is updated.
- Continued Use:Your continued use of AfricaVotes after changes are posted means you accept the revised terms. If you do not agree, you must stop using the affected service.
Where a change materially affects a paid feature already purchased, AfricaVotes will apply the change fairly and may provide in-product notices, email notices, or support guidance where practical.
Section 04
Access Provisions
Access to AfricaVotes is granted for lawful, genuine, and authorized participation in voting, event, ticket, live stream, organizer, and account services.
- Personal and Authorized Use:You may use the Website only for your own lawful participation or for an organizer/team role that has been properly assigned to you.
- Accurate Information:You must provide accurate emails, phone numbers, names, payment details, organizer details, and project details whenever the Website requests them.
- Account Security:You are responsible for protecting your login sessions, devices, email accounts, phone numbers, passwords, one-time codes, and payment approvals.
- Team Access:Organizer owners and team members must act only within their approved workspace, assigned asset, and role permissions.
- System Integrity:You may not bypass access controls, session checks, account review, organizer approval, role permissions, payment confirmation, geographic restrictions, or anti-abuse systems.
- Data Access:You may not scrape, harvest, copy, bulk export, or reuse Website data except through features expressly provided by AfricaVotes for that purpose.
Access may be refused, limited, suspended, or revoked if AfricaVotes reasonably believes an account, device, payment method, team role, or session creates security, fraud, compliance, or platform integrity risk.
Section 05
Prohibited Activities
Users must not misuse the Website, interfere with fair participation, or attempt to gain an unfair technical, financial, voting, ticketing, or organizer advantage.
- Unauthorized Automation:Bots, scripts, device farms, fake sessions, vote manipulation tools, and unauthorized automated voting are prohibited. Authorized Lazy Voting is allowed only when enabled through AfricaVotes and used within its rules.
- Fraudulent Identity Use:Fake accounts, stolen emails, stolen phone numbers, impersonation, account sharing for abuse, fake organizer identities, or misleading project ownership claims are prohibited.
- Payment Abuse:Chargeback fraud, stolen payment instruments, false payment confirmations, duplicate payment exploitation, refund abuse, and attempts to obtain votes, tickets, boosts, premium access, or stream access without valid payment are prohibited.
- Security Interference:Users may not probe, scan, attack, overload, reverse engineer, tamper with, or bypass any Website, API, session, verification, rate limit, payment, QR, ticket, or vote validation system.
- Content Misuse:Malware, phishing links, defamatory content, privacy-invasive content, illegal content, rights-infringing content, or abusive live stream/event content is not allowed.
- Data Misuse:Unauthorized scraping, copying, harvesting, resale, commercial reuse, mass download, deep linking, or republication of Website data, contestant data, organizer data, analytics, or user information is prohibited.
- Service Overload:Excessive requests, artificial traffic, denial-of-service attempts, crawler abuse, or any activity that harms performance for other users is prohibited.
- Result Manipulation:Any attempt to manipulate leaderboards, ticket validation, voting statistics, project outcomes, certificates, organizer revenue, analytics, or public results is prohibited.
Violation of this section may result in vote reversal, ticket cancellation, payment review, account restriction, organizer suspension, legal action, or referral to payment providers or law enforcement where appropriate.
Section 06
Geographical Restrictions
AfricaVotes operates across multiple countries, currencies, networks, and payment providers. Some services may therefore be unavailable, limited, delayed, or priced differently depending on where a user, organizer, payment method, or project is located.
- Legal Compliance:We may restrict access where required by law, regulation, sanctions, court order, telecom rules, payment provider rules, or government requirements.
- Payment Coverage:Certain mobile money, card, bank, currency, payout, ticketing, premium, boosting, or live stream payment options may only work in supported regions.
- Project Rules:Organizers may set project, ticket, category, event, or voting rules that limit access by location, eligibility, timing, age, role, or participation criteria.
- Security and Fraud Risk:We may block or review traffic from regions, networks, IP addresses, devices, payment routes, or accounts associated with abuse, fraud, high dispute rates, or system attacks.
- Service Quality:Live streams, ticket validation, payment confirmation, currency detection, and voting performance may vary because of network quality, device settings, browser behavior, or third-party service availability.
- User Responsibility:Users are responsible for ensuring their use of AfricaVotes is lawful in their location and that they can access the payment, voting, ticketing, or stream service before purchasing.
Section 07
Financial Terms
Paid services on AfricaVotes may include boosting, premium voting, lazy voting, tickets, live stream access, event tools, organizer services, or other paid features shown on the Website.
- Price Disclosure:Fees, currencies, quantities, taxes where applicable, and payment options are displayed before checkout or before the user confirms payment.
- Currency and Conversion:Prices may vary by country, currency, exchange rate, payment method, campaign setup, and provider fees. Displayed converted values are estimates unless confirmed at checkout.
- Payment Authorization:A transaction is valid only when the user authorizes payment and AfricaVotes or its payment provider confirms successful processing.
- Failed or Pending Payments:Pending, failed, reversed, cancelled, timed-out, unverifiable, or fraudulent transactions do not create valid votes, tickets, premium benefits, lazy voting access, stream access, or organizer credits.
- Processing Charges:Payment processing fees, telecom charges, card fees, bank charges, foreign exchange costs, chargeback fees, and third-party provider fees may be non-refundable.
- Final Transactions:Purchases are generally final once the paid benefit has been issued, recorded, used, consumed, or made available, except where correction is required by law, payment provider rules, duplicate charge review, cancellation policy, or verified platform error.
- Records and Receipts:AfricaVotes may generate receipts, email confirmations, ticket links, vote records, revenue records, or transaction references for audit, support, reconciliation, and compliance purposes.
- Chargebacks and Reviews:If a payment is disputed, reversed, flagged, or charged back, AfricaVotes may suspend related benefits, reverse votes, cancel tickets, hold payouts, restrict accounts, or request further verification.
Fee structures vary by campaign, organizer, country, payment method, currency, provider, and feature. Users should review the final payment screen before confirming any purchase.
Section 08
Premium Voting Terms
Premium Voting is an optional paid feature that gives eligible users enhanced daily voting power on projects where premium voting is enabled.
- Premium Voting is package-based. Available packages may include Starter, Fan, Super Fan, VIP, or any other package shown at checkout for the relevant project.
- Premium votes are not automatic votes unless a specific feature expressly states otherwise. Your selected package applies when you return and vote during an eligible daily voting cycle.
- Premium benefits activate after successful payment confirmation and remain available for the service period shown during purchase.
- Daily premium vote allocations expire at the end of each voting cycle and do not carry forward.
- A Premium user may upgrade to a higher available package where the Website allows it. Upgrade pricing, eligibility, and remaining daily benefits are calculated by AfricaVotes according to the active project rules.
- Premium benefits are account-specific, email-specific, project-specific, or session-specific as applied by the platform and cannot be transferred, resold, reassigned, or exchanged.
- Premium Voting does not guarantee any contestant, nominee, project, or participant will win, rank higher, or receive a specific outcome.
- Premium Voting may be unavailable or restricted for certain projects, categories, regions, deadlines, risk reviews, or compliance reasons.
- Premium purchases are final once processed, except where a refund is required by law, payment provider rules, or a verified platform error.
Boosting is an optional paid voting feature that allows users to purchase supplemental votes for an eligible contestant, nominee, category choice, ticket event, or other supported campaign item.
- Users must confirm the vote quantity, currency, payment method, project, and selected recipient before completing a boost transaction.
- Boosted votes are applied only after successful payment confirmation. Pending, failed, cancelled, reversed, fraudulent, or unverifiable payments do not count.
- Boosted votes are assigned to the selected recipient and cannot be transferred, redirected, split, or exchanged after a valid transaction is recorded.
- Bonus, promo, ticket, or live-event boost benefits apply only when active and eligible under the displayed campaign rules.
- Unless expressly stated otherwise, bonus or promo entitlements are one-time, non-stackable, tied to the relevant account, email, project, event, or campaign, and can be consumed once.
- Leaderboard, result, and analytics updates are processed as quickly as practical, but temporary delays may occur because of payment provider checks, network conditions, or platform review.
- Boost purchases are final once valid votes are processed, except where a refund or correction is required by law, payment provider rules, duplicate charge review, or verified platform error.
Section 10
Lazy Voting Terms
Lazy Voting is an optional authorized automation feature where a user instructs AfricaVotes to cast eligible votes on the user's behalf for selected projects, contestants, nominees, or campaign choices.
- By enabling Lazy Voting, you authorize the platform to perform eligible voting actions based on your selected recipient, active subscription or payment status, and the applicable project rules.
- Lazy Voting runs according to platform schedules and may depend on project availability, daily voting windows, payment confirmation, account status, and system integrity checks.
- Lazy Voting does not guarantee that every possible vote will be cast if a project closes, a rule changes, authorization expires, payment fails, access is restricted, or the service is unavailable.
- Users are responsible for confirming that the selected project, contestant, nominee, or choice is correct before enabling Lazy Voting.
- Lazy Voting cannot be used to bypass vote limits, country restrictions, project rules, anti-abuse checks, payment requirements, or account restrictions.
- AfricaVotes may pause, cancel, or refuse Lazy Voting where fraud, misuse, duplicate activity, technical risk, organizer restriction, or legal compliance concern is detected.
- Lazy Voting payments or subscriptions are final once processed, except where a refund is required by law, payment provider rules, or verified platform error.
Section 11
Ticketing Terms
Ticketing is an optional event feature that allows organizers to sell event access and allows buyers to purchase digital tickets through AfricaVotes.
- Buyers must confirm the event, ticket type, price, quantity, email address, phone number, and payment method before completing a ticket purchase.
- Tickets are issued only after successful payment confirmation. Pending, failed, cancelled, reversed, fraudulent, or unverifiable payments do not create valid admission rights.
- Ticket access details, QR codes, receipts, or print links may be sent to the email address or contact details provided during purchase. Buyers are responsible for entering accurate details.
- Each ticket may be validated, scanned, or marked as used according to the organizer's event rules. Duplicated, altered, resold, or suspicious tickets may be rejected.
- Ticket availability, seat/access limits, event timing, entry rules, and age or venue restrictions are controlled by the organizer and may vary by event.
- Ticket purchases are final once processed, except where a refund or correction is required by law, payment provider rules, event cancellation policy, duplicate charge review, or verified platform error.
- Ticket-linked promos or boost bonuses apply only when active and eligible under the displayed campaign rules, and do not apply to scheduled, expired, cancelled, or ineligible promotions.
Section 12
Live Stream Terms
Live Stream is an optional feature that allows eligible organizers or authorized team members to create, manage, promote, or view live broadcast experiences connected to AfricaVotes projects or events.
- Organizers are responsible for ensuring they have all rights, permissions, licenses, venue approvals, participant consent, and music/content clearances required for a live stream.
- Authorized team members who create or manage streams do so under the organizer workspace or assigned asset, and the organizer remains responsible for stream content and activity.
- Users may not broadcast illegal, abusive, defamatory, sexually exploitative, hateful, violent, copyrighted, privacy-invasive, or otherwise prohibited content.
- AfricaVotes may remove, disable, restrict, or refuse a stream where there is suspected abuse, rights infringement, fraud, security risk, organizer dispute, technical risk, or legal compliance concern.
- Stream availability and quality may depend on internet connectivity, device performance, third-party streaming providers, payment providers, browsers, and viewer network conditions.
- Unless expressly permitted by the organizer and applicable law, users may not record, restream, redistribute, scrape, download, or commercially exploit live stream content.
- Payments, access fees, tickets, promos, or stream-related benefits are final once processed, except where a refund or correction is required by law, payment provider rules, cancellation policy, or verified platform error.
The Website may contain or rely on links, embeds, payment pages, social login tools, maps, analytics tools, streaming tools, messaging links, organizer websites, ticket links, or other third-party resources.
- External Policies:Third-party websites and services are governed by their own terms, privacy policies, security standards, payment rules, refund rules, and content policies.
- No Automatic Endorsement:A link, integration, embed, payment option, stream provider, social provider, or organizer reference does not mean AfricaVotes endorses or controls that third party.
- User Choice:Users access third-party links at their own discretion and should review the relevant third-party terms before entering data, making payments, or relying on external content.
- Provider Availability:Social login, card processing, mobile money, email delivery, SMS, WhatsApp, analytics, maps, and streaming may fail, delay, or behave differently because of provider systems outside AfricaVotes control.
- External Content:AfricaVotes is not responsible for the accuracy, legality, security, availability, or conduct of external websites, organizer pages, advertisers, sponsors, venues, or third-party service providers.
- Safety:Users should not follow suspicious links, share passwords, approve unexpected payments, or rely on unofficial pages claiming to represent AfricaVotes.
Section 14
Communication Protocols
By using AfricaVotes, you agree that we may contact you where needed to operate, secure, verify, or support your account, votes, payments, tickets, organizer workspace, live streams, and related services.
- Transactional Messages:We may send payment confirmations, vote confirmations, ticket links, QR links, premium notices, lazy voting notices, organizer approvals, security alerts, support replies, and account-related messages.
- Service Notices:We may send notices about project deadlines, event updates, ticket changes, stream access, feature changes, fraud reviews, payout reviews, failed payments, chargebacks, or system maintenance.
- Marketing Messages:We may send promotional or educational messages about AfricaVotes features, campaigns, events, premium, boosting, tickets, or organizer services where permitted. Opt-out options may be provided where required.
- Communication Channels:Messages may be delivered through email, SMS, WhatsApp links, phone contact, in-app notifications, dashboard notices, browser alerts, or support chat depending on the feature and contact details supplied.
- User Accuracy:You are responsible for keeping your email address, phone number, organizer contact, and payment contact details accurate so receipts, ticket links, support replies, and security notices reach you.
- Electronic Consent:You agree that electronic records, checkboxes, button clicks, payment confirmations, email confirmations, OTP approvals, and dashboard actions may satisfy written agreement, notice, consent, and signature requirements where permitted by law.
Section 15
Intellectual Property
The AfricaVotes platform, brand, software, designs, text, graphics, layouts, workflows, databases, reports, analytics displays, code, icons, logos, and service names are protected by intellectual property laws.
- Platform Ownership:AfricaVotes and Xopa Limited retain all rights in the Website, dashboard, public pages, voting flows, ticketing flows, live stream tools, branding, software, databases, and proprietary service logic.
- Limited Use License:Users receive a limited, revocable, non-exclusive, non-transferable permission to access and use the Website for lawful personal, voting, ticketing, organizer, or assigned team purposes.
- Organizer Content:Organizers retain responsibility for content they upload, including project names, banners, contestant details, nominees, ticket events, live stream information, descriptions, images, and promotional materials.
- Content License to AfricaVotes:By uploading or submitting content, users and organizers grant AfricaVotes permission to host, process, display, resize, transmit, moderate, promote, and use that content as needed to operate the relevant service.
- No Unauthorized Copying:Users may not copy, reproduce, modify, resell, redistribute, scrape, frame, mirror, reverse engineer, or commercially exploit AfricaVotes content, software, data, or branding without written permission.
- Rights Clearance:Users and organizers must ensure they have the rights, releases, licenses, and permissions required for uploaded names, images, music, logos, videos, live streams, event materials, and contestant or participant information.
- Reporting Claims:Copyright, trademark, privacy, or image-right complaints should be sent to the contact addresses in Section 18 with enough detail for review.
Limited personal-use copying is permitted only where it does not violate these Terms, platform security, organizer rights, participant rights, or applicable law.
Section 16
Liability Disclaimers
AfricaVotes works to provide reliable voting, ticketing, payment, organizer, and live stream services, but the Website is provided on an "AS IS" and "AS AVAILABLE" basis to the maximum extent permitted by law.
- No Guaranteed Uptime:We do not guarantee uninterrupted, error-free, delay-free, or attack-free access. Maintenance, network issues, hosting issues, provider outages, device problems, or security events may affect availability.
- No Outcome Guarantee:AfricaVotes does not guarantee any voting result, ranking, winner, contestant performance, ticket sale volume, revenue amount, live stream audience, organizer approval, or promotional outcome.
- Third-Party Dependency:We are not responsible for failures caused by payment providers, telecom networks, email providers, SMS providers, social login providers, streaming providers, browsers, devices, banks, or venue operators.
- Limitation of Liability:To the maximum extent permitted by law, AfricaVotes and Xopa Limited shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to use of the Website.
- User Responsibility:Users are responsible for their own decisions, payments, voting choices, ticket purchases, content uploads, organizer actions, and any consequences of those actions.
